What is an Uncontested Divorce?
What does uncontested divorce mean? Both you and your spouse have agreed to terms regarding the division of community property and debts, child custody and co-parenting arrangements, and how support payments will be issued. Keep in mind, an uncontested divorce can only be filed if both parties agree to all related terms. We will guide you through the uncontested divorce process at every turn.
What Should You & Your Spouse Discuss Beforehand?
Parenting Plan: A parenting plan is an agreement between parents that outlines the amount of time a child will spend with each parent and how each parent will make decisions affecting the child's health and welfare.
Property Allocation: Get help in determining a fair split of your community property. If you and your spouse are able to agree on how to divide your assets, CMC Law Group can help you decide who gets what in your uncontested divorce.
Child & Spousal Support: CMC Law Group can propose a spousal or partner support amount using the income and expense information that you provide.
Process
1. One spouse starts the divorce process by filing the divorce petition, and accompanying forms with the Court and paying the required filing fees.
2. The filing spouse serves the other spouse with conformed copies of the petition.
3. The other spouse responds to the petition by filing a response with the Court.
4. Both spouses complete and exchange financial disclosure forms, which include required information about each spouse's assets, debts, income and expenses.
5. A settlement agreement is generated once both spouses agree on things like division of assets, support and custody. That agreement is then filed with the court.
6. Your post-divorce life begins!
